Commissioner of Oaths

Commissioners of oaths are authorized individuals under provincial or state law who can oversee and witness the swearing of oaths or solemn affirmations for affidavits in legal matters. They may also administer oaths for oral testimony. Additionally, they are authorized to witness declarations required by statute. The individual taking an oath, affirming, or making a declaration is referred to as a deponent or declarant.

The role of a commissioner of oaths is to certify that the oath, affirmation, or declaration was properly administered. They do not verify the truth of the statements in the document; this responsibility lies solely with the deponent or declarant.

In most jurisdictions, the process must comply with legal requirements. This includes the physical presence of the deponent before the commissioner of oaths, who must confirm the individual’s identity and signature. Identity verification is typically achieved by comparing the signature on the document with identification such as a driver’s license or passport.

Some commissioners of oaths who are not Notaries Public may have limited authority. For instance, a government employee might be commissioned solely for administering oaths related to their official duties.

Types of Oaths

  • When a notary public or a commissioner of oaths oversees the administration of an oath, the individual (known as the deponent) is asked to confirm:
“Do you swear that the contents of this affidavit, as signed by you, are true, so help you God?”
  • For those who prefer not to take an oath, they may instead affirm by answering ‘yes’ to the question:
“Do you solemnly affirm and declare that the contents of this affidavit, as signed by you, are true?”
  • If a solemn declaration is needed instead of an oath, the deponent will affirmatively respond to:
“Do you make this solemn declaration, conscientiously believing it to be true and understanding that it holds the same weight and effect as an oath?”

In all scenarios, the deponent must appear in person before the notary public or commissioner of oaths.
